Is Judea and Samaria "Occupied Territory"? Not According to U.S. Department of Defense Definition

U.S. Definition of "Occupied Territory":

"Territory under the authority and effective control of a belligerent armed force. The term is not applicable to territory being administered pursuant to peace terms, treaty, or other agreement, express or implied, with the civil authority of the territory."

From the 1993 Oslo Accords to today’s ongoing negotiations, seeking peace is nothing new. According to the above definition, and concurring international law, Judea and Samaria are in fact not Occupied Territories. Is the U.S. Administration aware of their own policy?
